The compliance certificate is regulated by Ministerial Decree 37/2008, and certifies that all the systems in the property comply with the provisions of the law. Here's how it works, where to find it, and what to use it for.
Compliance certificate The compliance certificate must be issued by the company that installed the system at the end of the work to ensure the conformity of the system and its smooth working. Which system requires the certificate:
electrical and electronic systems;
air conditioning, and heating;
gas distribution;
plumbing and water supply;
lift and elevator;
fire alarm and protection.
The statement is issued by the appropriate company, which is in possession of the licence, in case of installation, transformation and expansion of the systems and for each activity a project must be drawn up. On the other hand, the declaration is not necessary when routine system maintenance is carried out.
If you lose your compliance certificate? Whenever the compliance certificate has not been delivered at the end of the work or is no longer available because it’s lost, there are two scenarios:
if the system was built between 1990 and 2008, the compliance certificate may be requested, issued by a professional registered in the specific field of competence;
for installations after 2008, it is necessary the compliance certificate that, in case of loss, must be requested from the company that carried out the work or the one-stop shop for construction in the municipality.
When does the owner need the compliance certificate? The owner must deliver within 30 days from the installation of the system or new connection of a supply to the distributor a copy of the compliance certificate of the system, in order to ensure the proper use and operation of the system. In the event that it is not delivered, the supplier may suspend the distribution of the service.
The compliance certificate is also necessary for the issue of the certificate of usability of the property, useful for being able to live there as it ensures that the house meets the criteria of health, hygiene, safety and energy savings.
In addition, the compliance certificate is useful but not mandatory in case of sale of the property. Specifically, it is not mandatory for the deed but it would be better to deliver it in order to avoid any future disputes about the proper functioning of the systems.
When selling a home, in addition to the compliance certificate, must be attached the user and maintenance booklet of the facilities and all administrative and technical documentation.
